GETTING YOUR LICENSE BACK AFTER A DUI CONVICTION

1ST OFFENSE DUI

If you have been convicted for a DUI and are wondering how you can get your driving privilege back. If you were convicted of a 1st offense DUI you will be immediately eligible for a business/hardship license. However, you must have completed DUI school in order to obtain this license. After your court ordered suspension is up your business license will turn into a regular license. Usually the Court imposes a 6 month suspension on a first time DUI conviction.

1ST OFFENSE DUI > .15

If you blow over a .15 you will need to have an ignition interlock device installed in your vehicle prior to the DMV issuing you a hardship license. Usually this is a 6 month requirement. If you need information regarding the interlock device click on the link. If you get caught driving without the device you will be facing 30 days jail in Hillsborough County.

2nd Offense DUI

If you have been convicted of a 2nd offense outside of 5 years you will be suspended for 6 months up to a year. You are not eligible for a hardship license until the court ordered suspension is up. This is true even if your prior dui conviction was over 20 years prior. Furthermore you will have to install the ignition interlock device for a minimum of one year.

2ND DUI OFFENSE WITHIN 5 YEARS

If you have been convicted of a DUI within 5 years of a prior conviction your license is suspended for 5 years. You will not be eligible for a hardship license until you go one year without driving. Furthermore, you will be required to install the ignition interlock device in your vehicle for a minimum of 1 year.

2ND DUI CONVICTION WITH A BREATH TEST > .15

There is a minimum requirement of installation of the ignition interlock device for 2 years.

3RD CONVICTION FOR DUI OUTSIDE OF 10 YEARS FROM THE SECOND CONVICTION

You will be sentenced by the court and you will not be eligible for a license until your suspension period has run. The usual suspension is for a period of one year. The ignition interlock device is required for at least 2 years

3RD CONVICTION WITHIN 10 YEARS OF THE SECOND

You will lose your license for a minimum of 10 years and are not eligible for a hardship for at least 2 years.

4TH CONVICTION: NO REINSTATEMENT
