DHSMV Hearing |10 Days To Challenge Your DUI License Suspension

For almost every Tampa DUI arrest, the Florida DHSMV (Department of Highway Safety & Motor Vehicles) plays a part because it is the DHSMV that dictates your ability to drive in Tampa. As a result of being arrested, your license was taken by the Tampa police officer and your privilege to drive has been suspended.

However, as your Tampa DUI lawyer, have the ability to challenge your license suspension and potentially reinstate your full driving privileges. After your DUI arrest, you have 10 days to schedule a hearing with the DHSMV to determine whether you will retain your driver’s license. This is often referred to as the “10 day rule.” If you do not schedule this hearing within 10 days your license will be automatically suspended for up to 18 months. WE WILL SCHEDULE YOUR FORMAL REVIEW HEARING AND ACQUIRE A TEMPORARY DRIVING PERMIT FOR YOU!

At Finebloom & Haenel, our TAMPA DUI lawyers are experienced in representing clients at their Tampa DHSMV hearings. We know what techniques work and what information is needed to give you the greatest advantage and help you keep your driver’s license.

DHSMV Hearings in Tampa, Florida (Hillsborough County)

A DHSMV hearing has two main parts: an informal hearing and a formal hearing. Both are conducted by a DHSMV employee who will determine the outcome of your DUI. A Tampa DUI lawyer may represent you at both hearings.

The informal hearing is conducted by a DHSMV employee who reviews all the information provided by Florida law enforcement regarding your DUI.

The formal hearing is conducted by the same employee who will act as your prosecutor and judge. Certain important factors will come into play at this point, all of which could affect the outcome of your hearing. Some of these factors include:

  • Did the police officer have reasonable cause to pull you over?
  • Did the police officer read you your Miranda rights?
  • Were you informed of the consequences of refusing a breath or blood test?
  • Was your breath test performed properly?
