Holiday Man Charged With DUI For Sleeping In A Van Parked In His Driveway

When it comes to DUI charges in Florida, one of the most important terms you need to know is “actual physical control”. This term has been hotly contested in courtrooms by Tampa DUI attorneys and DUI lawyers throughout the state of Florida. Many people are unaware that you don’t need to be driving or even have your car running to be charged or convicted of drunk driving. Just ask Jeffery Roger Werling of Holiday, Florida.

The 40-year-old Pasco County resident was charged with DUI when he was found asleep in a van parked in his driveway. He was passed out in the driver’s seat and eventually given a blood-alcohol test which registered more than four-times the legal limit. The man told police he had consumed beer and vodka that night. He was booked into the Land O’Lakes jail.
