Life After A Tampa DUI

As many of you may already know, a Tampa driving under the influence conviction does not end when all the fines are paid and penalties are satisfied. Unfortunately, this is the type of conviction that you will be asked about in other aspects of your life. Here’s a look at the three most common areas that individuals with a DUI conviction have to continue dealing with:

  1. Insurance—Insurance companies reward drivers for good behavior with reduced rates. Conversely, they punish drivers for what they consider bad behavior with increased rates. Hillsborough County Penalties for First DUI Conviction

According to the Florida Department of Motor Vehicles, there were 3,256 DUI convictions in Hillsborough County in 2010. With numbers like that there is one conclusion that you should draw from it—Hillsborough County police take driving under the influence incidents very seriously. Local police are some of the strictest in the state when it comes to locating drunk drivers. In Hillsborough County, police typically perform a breath or chemical (blood) test to determine if the individuals’ blood alcohol content is over the legal limit of .08. Although neither of these tests are fool proof, they are very persuasive evidence against the driver in court.…

Can You Refuse A Chemical DUI Test In Tampa?

Driving is a privilege and not a right in the United States. Because of this important distinction, in order for the state of Florida to bestow upon you the privilege of getting behind the wheel, you have to agree to some important conditions. One item you agreed to went into place the second you signed for your license. Known as implied consent, Tampa drivers essentially consented to taking DUI testing whenever the police suspect you of driving under the influence. That may not seem fair since many of you would like that decision in the moment rather than having to say yes at the DMV years ago, but such is the reality of driving in Tampa.…

Can You Refuse A Breath Test In Tampa, Florida?

Driving with a BAC of .08 or above in Florida is a very bad idea. The police in Tampa are always on the lookout for drunk drivers and do not look kindly on those drivers that do not cooperate with the system. But a .08 BAC is not a number police can arrive at without the help of chemical testing. To determine with such specificity if a driver is over the legal limit in Tampa, police will often request that the driver take a breath test. The breath test measures a driver’s blood alcohol level by determining the amount of ethanol (a key ingredient in alcohol) in his or her breath.…

Being Arrested For DUI Does Not Mean You Will Be Convicted Of A DUI

Being arrested and charged with DUI does not mean you will be convicted of DUI.  A Tampa Defense Lawyer can evaluate your case and keep you from being convicted of a DUI and possibly have your DUI charge reduced.

There are several ways to beat a DUI.  One of the first challenges to any DUI arrest is the reason for the stop of the vehicle.  There are also ways to challenge your performance on the Field Sobriety Exercises by arguing that the area was poorly lit or the ground was uneven.  Finally, there are ways to challenge the breath test results by acquiring the video from the Hillsborough County Jail and evaluating the time frame of your entry into the sallyport area and the time of your first breath sample.…
